Articles, Publications and Lectures:<\/b><\/p>

During my employment as a Los Angeles County Deputy District Attorney I wrote several articles which appeared in the D.A. publication, “Adeline” and I lectured as office liaison for the “Lawyer In The Classroom” program.<\/b><\/p>

During private practice I had legal articles published in a monthly newsletter circulated to the Teamsters by a Past President of the Los Angeles County Bar Assoc. I have also had legal articles appear in a monthly flyer, “The Castle Echo,” circulated to members of a charitable organization. I have also had my proposed revision to CALJIC 9.36 (California Jury Instructions, Criminal) accepted and published by the CALJIC Committee.<\/b><\/p>

Appellate Experience:<\/b><\/p>

Four important civil decisions which I secured and which became published legal precedent:<\/b><\/p>

1) Lyon v. Superior Court, 68 C.2d 446, 439 P.2d 1. As a Deputy D.A., I secured a contempt against an attorney who failed to pay any spousal support while feeding his St Bernard dog. His \u201cdefense\u201d was that he lacked the ability to make the \u201cfull payments ordered\u201d and, thus, had no duty to pay less. The Supreme Court agreed with the concept I initiated, i.e., that \u201cpartial ability\u201d to pay spousal support is a valid basis for contempt.<\/b><\/p>

2) Tarakjian v. Krone, 196 CA3d 1243, 242 CR 435. I secured a judgment for my client but had one letter in the defendant\u2019s name spelled wrong. The defendant filed bankruptcy and failed to list my client as a creditor thinking that the wrong spelling of his name would prevent enforcement of the judgment. The appellate court agreed with me that the debtor knew he had the judgment against him and should have listed it regardless of the wrong spelling of his name and so I won the right to enforce the judgment despite the bankruptcy.<\/b><\/p>

3) Rentzer v. Unemployment Ins. Appeals Board, 32 CA 3d 604, 108 CR 336. I changed the law in the State of California concerning Tubal (Ectopic) Pregnancy. Women who suffered this condition were denied disability benefits on the theory that \u201cpregnancy\u201d was not a condition the disability law was designed to pay for. I argued that a tubal pregnancy was not a true pregnancy and was an illness for which full benefits should be paid. The appellate court agreed with me and from that date forward all women in the State of California became entitled to collect disability benefits when they were off work due to tubal pregnancies.<\/b><\/p>

4) Aguimatang v. Calif. State Lottery, 234 CA 3d 769, 286 CR 57.\u00a0 <\/span>This case involved a sixteen- million-dollar lottery prize which went unclaimed by an alleged fourth winning ticket. I won the right to produce evidence on the issue of whether or not there was proof no fourth ticket was issued since that had been used by the lottery to divide the grand prize by fourths and only pay the three claimants a quarter share rather than a one third share.\u00a0<\/span><\/b><\/p>

In addition to the above \u201cPublished\u201d civil opinions I have presented briefs, totaling in the hundreds, to the Los Angeles County Superior Court Appellate Division, the Ventura County Superior Court Appellate Division, the State District Court of Appeal, the California State Supreme Court, the United States District Court of Appeal for the 9th Circuit and the Supreme Court of the United States, which have included Petitions for Writs of Prohibition and Mandate as well as numerous Post Conviction Appellate Briefs, a good percentage of which were successful and some of which were published.\u00a0<\/span><\/b><\/p>

Recent \u201cVictory\u201d<\/b><\/p>

People vs. Filiberto F (Case # LACBA 466919-01)\u00a0 <\/span>The L.A. District Atty, charged felony workers compensation insurance fraud on Middlesex Insurance Co., I secured a plea bargain for informal probation based on a plea of \u201cno contest\u201d to a misdemeanor. Middlesex Insurance Company then turned around and, alleging that criminal conviction, filed a civil suit against Filiberto alleging Insurance Fraud (Case #: 20STCV12320). Filiberto\u2019s attorney referred him to me to deal with that and I drafted a dismissal motion which that attorney filed and which secured a dismissal of that allegation (since a \u201cno contest\u201d plea to a misdemeanor cannot be alleged in\u00a0 <\/span>a civil suit). \u00a0 <\/span>Middlesex attorneys then filed an amended complaint alleging plain Fraud and Deceit.\u00a0 <\/span>I informed them doing so violated Filiberto\u2019s freedom of speech as it put a \u201cchilling effect\u201d upon his maintaining his ongoing Worker\u2019s Comp. case.\u00a0 <\/span>They claimed there was \u201cno freedom to defraud.\u201d\u00a0 <\/span>So, still handling the matter for Filiberto\u2019s Workers Comp. Attorney, I drafted an \u201cAnti-SLAPP\u201d motion.<\/b><\/p>

The court not only granted my motion and dismissed their suit but, over their objection, awarded me the full $20,750.00 which I sought in attorney fees and costs.\u00a0 <\/span>Then, as soon as it was paid, I surprised Filiberto by, as a gift, refunding the entire retainer he initially paid me.\u00a0<\/span><\/b><\/p>

(He now sends me a Christmas card every year.)\u00a0<\/span><\/b><\/p>

More Recent \u201cVictory\u201d<\/b><\/p>

U.S. vs. Joel L Case #CR 22-418-SB (Conspiracy to Commit Health Care Fraud, Aggravated Identity Theft and a $551,810.09 Criminal Forfeiture). Result: Plea bargained down to $3,221.81 restitution, $100.00 Special assessment, no fine and 3 years formal probation (no prison \/no jail.)\u00a0<\/span><\/b><\/p>

This criminal case was followed with a Civil Suit 23STCV30232 by the People of The State of California \u201cex rel\u201d (on behalf of) an insurance company which covered the Los Angeles Port Workers (\u201cIL WU-PMA Welfare Plan,\u201d et al) alleging a conspiracy among a business and 11 individuals (of which Joel was one)\u00a0 <\/span>seeking money damages for Violation of The Insurance Frauds Prevention act, California Insurance Code Section 1871.7, Unfair Competition Act, California Business and Professions Code Sections 17200 ET SEQ, seeking the amount of \u201cbetween $40,190,000.00 and $80,380,000.00\u201d for Fraud plus $8,272,851.90 for violation of the insurance code and $1,722,408 in restitution. Result, Total Dismissal in exchange for a $15,000.00 payment.\u00a0<\/span><\/b><\/p>
